When was "Opihi Moemoe" originally written and by whom? I'd like to know who holds the copyright. I put together an arrangement for standard ukulele, but don't want to put it in the public view if this work is presently copyrighted.

I'd appreciate any background on this piece that can help me to identify its origins.

Leonard Kwan "wrote" it. I am not sure how you can tell exactly when, because he played several versions. It is in the "Red Book" with tab by Dennis Ladd, copyright 1980. Tradewinds recording (which will give you legal fits).

Check this link and scroll down to read the liner notes for New 'Opihi Moemoe. There's info about 'Opihi Moemoe, such as that it was composed around 1958.

I have also read that Leonard did not name his own pieces (or at least, the 'Opihi trilogy). The 'opihi names were made up by Margaret Williams, owner of Tradewinds.

Thanks for the feedback! I think there are too many companies, individuals, and heirs, with too much money and too many "moral claims" for me to want to risk putting my version for standard ukulele up on my web site. I'll just enjoy what I cam up with for "personal study". It was worthwhile just to work through the related concepts to gain insight into slack key music.

Just an update. I searched the Copyright Office records, and found a record company that had recently recorded Opihi Moemoe. I asked from whom they had gotten permission to make the recording of a variation on the work. They responded as follows:

"Hi

As far as I know, Opihi Moemoe is not public domain. Leonard Kwan passed away, and I believe his sons administer his works. This is the info I have:

Leonard Kwan Jr.

Keala Music

89-1072 Pohakupalena St.

Waianae HI 96792

I show them registered with BMI. Hawaiian song research is very confusing; the same song can be listed under various names and spellings. I do not have an email for Keala Music.

Hope this helps."


I think I'll follow the Copyright Office guidelines I received in an e-mail from them, and restrict myself to having fun with works that are pre-1927 if I haven't written them.
